These Terms of Service ("Terms") govern your access to and use of thedataexperts.us and any related pages, forms, and content (collectively, the "Site"), operated by Data Science & Engineering Experts, Inc. ("DSE," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Engagement-specific terms live in your signed Master Service Agreement ("MSA") and Statement of Work ("SOW"). Those signed documents govern our consulting relationship and prevail over anything in these Terms to the extent of any conflict.
Use of the Site
The Site is provided for general informational purposes. You agree not to:
- probe, scan, scrape, or crawl the Site beyond what robots.txt permits;
- submit forms with intent to deceive, impersonate, or defraud;
- reverse-engineer, decompile, or attempt to extract source from any embedded service;
- introduce malware or interfere with the operation, integrity, or security of the Site; or
- use the Site in violation of any applicable law.
We may modify, suspend, or discontinue any part of the Site at any time without notice.
No professional advice
Content on the Site (including articles, the Refinery Report, frameworks, code samples, and any general commentary) is provided for informational purposes only and does not constitute professional, legal, financial, data-governance, or technical advice, and does not create a consulting, advisory, or fiduciary relationship. Professional advice is delivered only under a signed MSA and SOW. You should not act on Site content without engaging DSE or another qualified professional for advice specific to your circumstances. Any unsigned communication (including email, forms, and pre-engagement discussions) is informational only and is not a deliverable or a commitment.
Intellectual property
All content on the Site (including text, design, layout, graphics, code samples, and the Refinery Report) is © Data Science & Engineering Experts, Inc. unless attributed otherwise, and is protected by intellectual property laws. DSE retains all right, title, and interest in its tools, methodologies, frameworks, and reusable components. Short, attributed quotations for commentary or reference are welcome. Bulk reproduction, redistribution, or commercial use requires our prior written permission. All trademarks and service marks displayed on the Site are the property of DSE or their respective owners.
No warranty
THE SITE AND ALL CONTENT AND UNSIGNED COMMUNICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that the Site will meet your requirements or that defects will be corrected. You use the Site at your own risk. Engagement deliverables are warranted solely as expressly set out in the applicable signed SOW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO YOUR USE OF THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
This cap does not apply to liability for gross negligence, willful misconduct, fraud, death or personal injury caused by our negligence, or any liability that cannot be limited under applicable law. Liability arising from a consulting engagement is governed exclusively by the limitation-of-liability provisions in the applicable MSA, not by this Section.
Third-party links
The Site may link to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of third-party sites is subject to their terms.
Governing law and venue
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site is subject to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there.
Changes to these Terms
We may update these Terms at any time. Changes take effect when we post the revised Terms to the Site and update the "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
Engagement documents
Full client artifacts (the Master Service Agreement (MSA), Data Processing Addendum (DPA), and Incident Response terms) are provided at engagement start and are incorporated into the signed relationship. To request these documents, contact legal@thedataexperts.us.
